On September 6, 2018, Ruby’s Diner, Inc. (“RDI”) the founder and operator of Ruby’s Franchise Systems, Inc. (“RFS”) filed for chapter 7 bankruptcy protection. In November 2020, a group of investors purchased some of those assets with the intent of restoring the Ruby’s Diner Brand to its former glory and beyond. That purchase did not include any assumption of obligations for the bankrupt company’s prior debt or gift card liabilities. As a result, the restaurants no longer have the ability to access the prior gift card system in order to determine value or redeem any outstanding gift cards from the bankrupt company.
